On Our Way to the Third Way: The FCC’s Notice of Inquiry on Internet Regulation

Kennedy discusses the June 17th announcement of the Notice of Inquiry by the Federal Communications Commission asking for comment on the authority of the FCC to regulate broadband Internet service.  The NOI asks for comment on three possible ways of regulating the internet.  The “Third Way” which calls for reclassification of broadband appears to be the only real option on the table for the FCC in Kennedy’s opinion.

NOI asks for help with policy in five specific areas:

  1. Universal Service
  2. Privacy
  3. Access to services for the disabled
  4. Public Safety/Homeland Security
  5. Harmful Practices by ISP’s

Kennedy believes that it is clear that there is no need to reclassify considering that there is no strong evidence for why it should be removed from Title I classification.  And without consensus, then it would be unreasonable to do so.
