The Autorite de la concurrence orders Google to implement in an objective, transparent and non discriminatory manner the content policy of its AdWords service

Navx, a GPS company who maintains online databases of geolocation makers, issued a complaint against Google to the Autorite. Navx claims that Google is active in anti-competitive practices in online advertising. Autorite has made a temporary decision while it investigate for its final action. At the moment they feel that Google holds a dominant position and is used for 90% of all searches in France.
The Autorite stated that,
Pending a full investigation and a decision on the merits, the Autorite is also of the view that Google has implemented the content policy of its AdWords service in a way which lacks objectivity and transparency, resulting in a discriminatory treatment of speed camera database suppliers. The Autorite has therefore decided to grant interim measures.
The Autorite has decided to move forward with interim injunctions toward Google. And will continue to investigate the matter further. The injunctions include:
- Google Ireland and Google Inc. must clarify, within a four months period following the notification of its decision, the scoep and impact of the AdWords conditions applicable to devices aimed at evading traffic speed cameras.
- Google Ireland and Google Inc. must clarify, within a four months period following the notification of its decision, the AdWords processes that may lead to an advertiser’s account being suspended.
- Google Ireland and Google Inc. must restore, within five days period following the notification of its decision, the AdWords account of Navx.
